Employment Law

Employment law is the collection of laws and rules that regulate relationships between employers and employees. Employment law dictates when an employer can hire employees, when the employees can work, and what an employer must pay the employee for their work. Employment law creates minimum requirements for working conditions for employees.

Good or bad, hiring an employee is so much more than just saying “can you start on Monday?” A few aspects that an employer must consider include…

  • Minimum wage laws that require the employer to pay a certain amount
  • Laws that prohibit the employer from discriminating against applicants or employees based on certain characteristics (important to the interview and hiring process)
  • Laws requiring that employers provide a safe working environment
  • Whether they are required to provide health insurance options
  • Requirements for employers to collect and submit payroll taxes on behalf of the employee
  • Is the employer discriminating in speech or action during interviews, hiring, or work interaction
  • And so much more

With so many regulations to comply with, employers are often overwhelmed and do not even know what they are not doing. For this reason, we are here to help!

Some of the most common employee grievances that result in complaints with the Equal Employment Opportunity Commission (EEOC) and/or lawsuits include…

  • Discrimination – Employees and even prospective employees may not be discriminated against for certain characteristics, such as gender or nationality.
  • Sexual Harassment – Considered a form of discrimination, harassment occurs when inappropriate sexual behavior prevents the victim from doing his or her job.
  • Wage and Hour – Your employer is legally obligated to pay at least the minimum wage, pay overtime when hours exceed 40 per week, and abide by other wage and hour laws.
  • Wrongful Termination – Employers may not fire you out of retaliation for a legal complaint or for protected characteristics (such as race, gender, pregnancy, etc.).

We are here to make help employees ensure that their business is compliant with all aspect of employment law and to vigorously protect those employees who have been taken advantage of by uninformed and/or indifferent employers.
